Remaking Wonderland-related content of inactive users

I have a problem: I'd like to remake a custom leveltex for WA trilogy, which was made by inactive user, in this case by Com Rante. I PMed him to ask for permission, but he didn't reply. What would you do in such situation and what do you generally think about relations between active users and inactive users' content?

I'd proceed anyway, explaining the situation in the forum post. Then again, MS is active and I've created "remixes" of four Wonderland levels (my "Deja-Vu" series) without asking MS for permission, so I'm in a bit of a shady gray area here. So I have to admit that I honestly don't know. :?

Well, that's a valid and invalid point at once. Valid, because the thing with MS is true, but on the other hand MS created the games, so basically everything what's made with and for Wonderland stuff is more or less a remake of MS's work. So I still don't know what to think...

In my case, not a single tile from the original Com Rante's texture was used, everything is made by me, but it is meant to resemble his work. I'd say it's inspired by his texture, so I guess I'll upload the texture. I'll wait few more days for the reply though.

I'm curious if there's anyone who has a clear opinion about the case.

It doesn't seem like a big deal to me. I'd do it anyways.

It's not like you'll be sued for making textures that look similar to another user's :P

Yeah, but except courts there are still things called kindness and respecting others' will. But honestly, if someone had a good idea and left the case because they wanted to I find it unfair to block other users who are still active from exploiting those good ideas, so I decided to upload the texture.
