It's safe to use the tracks from video games. I'm sure it's legal all together, anyway.

Since I know you are talking about the archive Aryan, I wouldn't put them in.
Nintendo is very serious about copyright, even when it came to fan games until recent times.
Its perfectly legal in its current state, a nonprofit game, but wouldn't be as part of the archive.
